Fact Sheet on General Product Safety

Do you place products on the market that are intended for consumer use or that may end up in private use? Are you familiar with the legal requirements? Are your products considered “safe products”? Are you aware that products that do not meet the required safety standards must be withdrawn from the market?

Regulation (EU) 2023/988 on general product safety entered into force in mid-June 2023. Its provisions will apply directly in all Member States as of December 13, 2024. The regulation will then replace the Product Safety Directive 2001/95/EC from 2001.

The regulation takes into account the increasing digitalization and the growing share of online commerce and aims to protect consumers even better from dangerous products. To achieve this, economic operators and online marketplace providers will in the future be subject to more extensive requirements, ranging from reporting product incidents to the authorities to the necessity of having a responsible person established within the EU. In addition, the new regulation contains provisions on conducting product-specific risk assessments and on the design and implementation of recalls.
