The Digital Networks Act (DNA) was adopted by the European Commission as a proposal today. It introduces a new framework for regulating electronic communications and digital networks in the European Union.

What is the Digital Networks Act?

The Digital Networks Act (DNA) is a proposed EU legislative act intended to modernise and harmonise the rules for electronic communications and digital network infrastructure across the European Union.
It applies to services such as mobile communications, broadband internet and other electronic communications networks.

Why did the European Commission introduce the Digital Networks Act?

The Digital Networks Act  is intended to replace or substantially overhaul the European Electronic Communications Code (EECC) of 2018, and will update the EU’s telecommunications regulatory framework in light of technological developments and the increasing importance of digital networks.

How does the Digital Networks Act differ from other EU digital legislation?

The Digital Networks Act focuses specifically on telecommunications networks and electronic communications infrastructure.
This distinguishes it from other EU digital laws, including:

  • the Digital Services Act (DSA), which regulates online platforms and digital services, and
  • the Digital Markets Act (DMA), which addresses market behaviour of large digital platforms.

The Digital Networks Act does not regulate online content, platform conduct or digital markets. Its scope is limited to networks, connectivity and the regulatory framework for electronic communications.

What does the Digital Networks Act mean for companies in Bavaria?

Because the Digital Networks Act is an EU-level legislative proposal, if adopted, it would apply uniformly across all EU member states, including Germany and Bavaria.
The Act does not contain provisions specific to Bavaria or to individual regions. Any effects for companies in Bavaria would result from the application of the same EU-wide rules that apply throughout the European Union.
