Products with good reputation

New geographical indications for artisanal and industrial products such as cutlery from Solingen or Black Forest cuckoo clocks should in future strengthen regions and manufacturers in European and global competition. The European Parliament and the Council have reached political agreement on a draft regulation from the EU Commission. The new rules will give special protection to products such as glass, textiles, porcelain, cutlery, pottery, cuckoo clocks, musical instruments and furniture. The products already enjoy a good reputation, but manufacturers have so far lacked EU rules to recognize and protect intellectual property.

The regulation will also ensure that traditional artisanal and industrial products are finally put on an equal footing with protected geographical indications, which already exist in the agricultural sector.

The new EU regulation on geographical indications for artisanal and industrial products will:

  • introduce EU-wide protection for protected geographical indications for artisanal and industrial products to help producers protect and enforce their products' intellectual property rights across the EU. It will also eliminate the current fragmented and incomplete protection at the national level. The new regulation will also facilitate online protection of artisanal and industrial protected geographical indications, as well as action against counterfeit products, including those sold online.
  • Protected geographical indications for artisanal and industrial products can be registered cheaply and easily through a two-step application process. A direct application procedure at the EUIPO will also be possible for member states that do not have a national registration procedure. This will benefit SMEs in particular.
  • Compatibility with international protection of protected geographical indications will be made possible by allowing producers of registered artisanal and industrial g. A. will be able to protect their products in all countries that have signed the Geneva Act on Appellations of Origin and Geographical Indications of the World Intellectual Property Organization (WIPO). It will now be possible to protect corresponding geographical indications from third countries within the EU.
  • The development of rural areas and other regions in Europe will be promoted by creating incentives for producers, especially SMEs, to invest in new authentic products and create niche markets.
