Federal Network Agency provides clarity on smart meter data retrieval

The Federal Network Agency clarifies that the consent of the connection user for the transmission of metering data does not have to comply with the BDEW recommendation.

In a statement on February 7, 2024, Decision Chamber 6 of the Federal Network Agency, which is responsible for regulating access to electricity supply grids, clarified that metering point operators must have "full" control of the so-called switching processes in metering (WiM processes). The authority is primarily referring to the request and transmission of measured values "by and to the ESA". The acronym stands for the market role of the energy service provider (ESA).

The "Act on the Adaptation of Energy Industry Law to EU Legislation and the Amendment of Other Energy Law Provisions", which came into force on December 29, 2023, granted the energy service provider the right to request the daily transmission of all measured values of a connection user that are collected and processed in the course of recording load profile metering at a metering point.

The market role of the energy service provider is not new. It was created by a decision of the Federal Network Agency in December 2020, but only gained practical relevance in 2022 with the "New version of the switching processes in electricity metering".

Standardized and automated data transmission

The energy service provider is therefore entitled to request measured values from a smart metering system from the metering point operator and order them as a standardized and automated delivery.

The Federal Network Agency's decision at the time was in response to information from energy service providers and energy data managers. These had complained that the processing of measured values by third parties at the request of the subscriber was only possible under difficult conditions, as there was no standardized and certainly no automated provision by the metering point operator. According to a definition by the authority, the energy service provider of the connection user requests and processes values on behalf of the connection user. The ESA must have the corresponding consent of the connection user.

This consent, according to the Federal Network Agency in its latest communication, does not have to correspond to the sample declaration of consent of the connection user drawn up by BDEW for the transmission of metering products from the MSB to the ESA. This is merely a recommendation. "The transmission of values to the ESA may therefore not be rejected on the grounds that a power of attorney or declaration of consent deviating from the BDEW sample has been submitted," writes the authority.
